Aegis Agility, LLC Red Sky Border Collies PUPPY SALES CONTRACT
The Seller, Aegis Agility, LLC, doing business as: Red Sky Border Collies, _____________________ and the Buyer, __________________________Hereby agree as follows: 1. The Seller hereby conveys to the Buyer, for the amount of $600.00, payment of which is hereby acknowledged, a male/female Border Collie puppy, born ____________, by _____________________, out of _______________, in accordance with the terms of this contract. A deposit of $300.00 by certified check or money order at the time of choosing your pup with the balance due prior to picking up or shipping. Shipping, if necessary, will be the responsibility of the Buyer. 2. The Seller guarantees that the puppy is in good health, and current with vaccines, on the date of delivery to the Buyer. The Buyer will be provided with a shot record upon taking possession of the pup. The Buyer shall have the pup examined by a licensed veterinarian and have vaccinations up to date for the health guarantee to be valid. If the Buyer fails to have the pup examined and fails to obtain immunizations the health guarantee will be null and void. The Seller will not be liable for costs or fees for the pups health examination and immunity vaccines after the pup is transferred to the Buyer. 3. The Seller guarantees that the puppy is free of hereditary defects to the best of my knowledge. Should the puppy be diagnosed with hip dysplasia prior to 27 months of age, or suffer loss of eyesight due to Progressive Retinal Atrophy (PRA) or Collie Eye Anomaly (CEA) prior to the age of three, the Seller agrees to refund the purchase price when the following conditions are met: 1. The pup must be spayed/neutered; and 2. The registration papers shall be returned to the Seller. The Buyer may keep the dog if she/he desires, but must present certification by a veterinarian if the complaint is hip dysplasia, along with a copy of the report from the Orthopedic Foundation, or a copy of the hip x-rays. If the complaint is PRA or CEA, a report from a Board Certified Veterinary Ophthalmologist must be sent to the Seller. The Seller does not assume any additional liability for possible genetic defects in the puppy, and will under no circumstances be responsible for veterinary bills resulting from any such condition. 4. Puppies must be spayed/neutered and are sold with a limited AKC registration unless the Buyer has plans to breed such pup, in which case, number 5 will be followed. |

5. The puppy shall not be bred unless it shall first (1) have been x-rayed and certified clear of hip dysplasia by OFA or other competent organization, such as Penn Hip, (2) have been certified clear of hereditary eye disease by a canine ophthalmologist, (3) be of sound temperament demonstrating no tendencies of aggression or excessive shyness, nor shall this pup be bred to a dog/bitch who does not meet the above criteria. Copies of certifications regarding hips and eyes must be sent to the Seller prior to the breeding of this pup. This pup may not be bred prior to the age of two. Buyers who may want to breed their pup will be given either a limited AKC registration, or will co-own the pup with the Seller until the Seller receives the clearances, at which time, either the limited AKC registration will be changed to unlimited; or the co-ownership will be terminated. If the Buyer elects to co-own the pup with the Seller, the Buyer assumes all responsibility for the pup, including, but not limited to, the health requirements, vaccines, yearly exams, rabies, heartworm tests, etc. The Seller assumes no financial liability for this pup under the co-ownership status. 6. The Buyer agrees to have this pups hips x-rayed and have the results of the x-rays either sent to OFA or agrees to send the x-rays to Penn Hip. A copy of the report of the hip x-rays will be forwarded to the Seller. 7. The Buyer shall maintain the puppy in good condition, including adherence to a regular immunization schedule (or titers), annual physical exam including tests for heartworm, heartworm preventative, good diet, and a clean, safe environment. 8. The laws of the State of Virginia shall govern this contract and any disputes that may arise will first go to an arbitrator from the State of Virginia. The Seller and the Buyer agree to accept the outcome of the arbitration. Failure to utilize an arbitrator will result in this contract being null and void. 9. If at any time in its life the puppy is to be sold or given away, the Buyer shall so notify the Seller and give the Seller first option to buy the puppy back at the original purchase price. The Buyer will pay shipping costs (if any). 10. The Buyer shall not sell the puppy, or its offspring (if any), to any individual or establishment in the business of buying and selling puppies for a profit.
